Diritto di Recesso

L'Utente ha il diritto di recedere dal contratto comunicandolo al Titolare in modo inequivocabile.

Come esercitare il diritto di recesso?

Per esercitare il diritto di recesso, l’Utente deve inviare una dichiarazione chiara e priva di ambiguità riguardante la propria intenzione di recedere dal contratto. A tal fine, può utilizzare il modulo di recesso disponibile nella sezione delle definizioni di questo documento, oppure può scegliere qualsiasi altra modalità di comunicazione che ritenga idonea.

Per rispettare i termini legali, la comunicazione deve essere inviata entro il periodo previsto per il recesso.

Termine del recesso

• Per l'acquisto di beni: L'Utente ha 14 giorni di tempo per esercitare il diritto di recesso, a partire dal giorno in cui lui stesso, o un terzo da lui designato (diverso dal corriere), entra in possesso del bene.

• Per acquisti multipli o beni consegnati separatamente: Se l'ordine comprende più beni consegnati in momenti diversi, il termine di 14 giorni decorre dal giorno in cui l’Utente, o un terzo designato, prende possesso dell'ultimo articolo, lotto o parte dell'ordine.

Effetti del recesso

Se l'Utente esercita correttamente il diritto di recesso, il Titolare provvederà a rimborsare l'intero importo ricevuto, inclusi eventuali costi di spedizione standard. Tuttavia, eventuali costi aggiuntivi derivanti dalla scelta di un metodo di consegna diverso da quello più economico offerto resteranno a carico dell'Utente.

Il rimborso verrà effettuato senza indebito ritardo, entro 14 giorni dalla ricezione della comunicazione di recesso, utilizzando lo stesso metodo di pagamento impiegato dall'Utente per l’acquisto, salvo diverso accordo. Non verranno applicati costi aggiuntivi per il rimborso.

Restituzione dei beni

A meno che il Titolare non abbia offerto di ritirare i beni, l'Utente deve restituirli al Titolare o a una persona da lui autorizzata senza indebito ritardo, e comunque entro 14 giorni dalla comunicazione del recesso.

Il termine sarà considerato rispettato se i beni verranno consegnati al corriere o a una persona autorizzata prima della scadenza del periodo di 14 giorni. Il rimborso potrà essere trattenuto fino a quando i beni non saranno stati ricevuti, oppure fino alla prova da parte dell’Utente della loro avvenuta spedizione.

Responsabilità dell'Utente

L'Utente sarà responsabile della diminuzione del valore dei beni dovuta a un uso diverso da quello necessario per verificarne natura, caratteristiche e funzionamento.

Right of Withdrawal

The User has the right to withdraw from the contract by providing clear and unequivocal communication to the Owner.

How to exercise the right of withdrawal?

To exercise the right of withdrawal, the User must send a clear and unambiguous statement indicating their intention to withdraw from the contract. For this purpose, the withdrawal form available in the definitions section of this document may be used, or the User can use any other suitable form of communication.

To comply with the legal withdrawal period, the statement must be sent before the withdrawal deadline expires.

Withdrawal period

• For the purchase of goods: The User has 14 days to exercise the right of withdrawal, starting from the day the User or a third party designated by the User (different from the courier) takes possession of the goods.

• For multiple purchases or goods delivered separately: If the order consists of several items delivered at different times, the 14-day withdrawal period starts from the day the User or a designated third party takes possession of the last item, batch, or piece.

Effects of withdrawal

If the User correctly exercises the right of withdrawal, the Owner will refund all payments received, including any standard shipping costs. However, any additional costs resulting from the User’s choice of a different delivery method than the least expensive standard delivery option offered by the Owner will be borne by the User.

The refund will be made without undue delay and, in any event, within 14 days from the date the Owner is informed of the User’s decision to withdraw from the contract. The refund will be issued using the same payment method used for the initial transaction, unless otherwise agreed with the User. No fees will be applied for the refund.

Return of goods

Unless the Owner has offered to collect the goods, the User is required to return them to the Owner or a person authorized by the Owner without undue delay, and in any event, within 14 days from the date the User communicates the intention to withdraw from the contract.

The deadline is met if the goods are handed over to the courier or to an authorized person before the 14-day period expires. The refund may be withheld until the goods are received or until the User has provided proof of having returned them.

User’s responsibility

The User is liable for any reduction in the value of the goods resulting from handling them in a way other than what is necessary to establish their nature, characteristics, and functionality.
